Open Sourcing with Mac OS X

I was recently watching a stream and there was an Advertisement on the side that said ” Open With Mac OS X”. Quickly, I realized that the Mac OS X platform is not open source and you cannot legally install it with any other platform. Is this some type of joke?
These are just my thoughts and you all do know what a stickler I can be, but I am very curious about open sourcing with OS X

Hey there Tyle,
The psystar computers are in debate right now, apple has filed a law suit that started injune or july. They have not shut down the company because they are building a case against them. It is leagal for you (the comsumor) to by one but it is illeagal for them to install it for you. If this lawsuit goes apples way then psystar will leagaly have to stop installing osx on these computers but can still sell the computer meaning (you can install OSX your self leagly) so you can by one It’s legit and not illeagl for you.
